SHIFT Product, Licence and Support Terms

1. Scope

These Terms govern the delivery, licence, characteristics, support and conformity of the SHIFT products supplied by José Covas Education Academy, Lda (the "Academy") — namely the individual occupation document, the annual pass, and additional occupations added to either. The purchase and payment are made to Paddle, as authorised reseller and Merchant of Record, and are governed by the Paddle Buyer Terms and Paddle Refund Policy. By completing the transaction through Paddle, the buyer also accepts these Terms in relation to the supply and use of the product. Where a mandatory consumer-protection rule conflicts with these Terms, that rule prevails.

2. Status

While sales are not active, no product is offered for sale and no payment is taken. The product page is shown for design and review only. These Terms become operative only when the live index is connected and paid products are activated.

3. The products

3.1 The occupation document. Digital content consisting of (a) a private page hosted by the Academy, covering one kind of work across every market for which the Academy publishes data for that work, and (b) the same content as a PDF file available for download. Access is granted to the buyer's account after Paddle confirms the transaction. The PDF is the buyer's to keep: once downloaded it can be saved and read offline for as long as the buyer wishes, with no expiry. The private page is hosted by the Academy and is kept available for at least 24 months from purchase; the Academy gives at least 60 days' notice by email before withdrawing a private page, so that the PDF can be downloaded. The document covers the edition current at the time of purchase; later editions are not included. Each product page identifies the subject, coverage, reference date, methodology, format and limitations.

3.2 The annual pass. A subscription of twelve months which includes, for up to three kinds of work: the content described in 3.1, a refresh of the underlying counts every three months, the history of previous refreshes, and any new edition published while the pass is in force. The pass renews automatically each year unless cancelled; the Academy notifies the buyer by email at least 14 days before each renewal. If the pass ends, whether by cancellation or non-renewal, the buyer keeps everything already made available to them under 3.1 — the PDFs are theirs to keep, and the private pages remain available on the terms set out there, and simply ceases to receive further refreshes and editions.

3.3 Additional kinds of work. Further kinds of work may be added to a document or to a pass, up to a total of eight, at the price shown at the time.

3.4 Moving from a document to a pass. Within 30 days of buying a document, the buyer may move up to the annual pass by paying the difference between the two prices. Where more than one document has been bought, only the most recent one is taken into account. After 30 days, the pass is bought at its full price.

3.5 Access requires a device with Internet access and a valid email account; the PDF requires software able to open PDF files. No installation is required, the PDF contains no digital-rights-management mechanisms, and it can be saved and read offline after download.

3.6 The products provide general information and methodological commentary. They do not constitute personal career, recruitment, legal, financial, investment or employment advice, nor do they, on their own, allow the causes of the observed changes in the indicators to be determined.

4. Price, payment and commercial document

The reference price of each product is shown on the product page. The final price, the transaction currency, the applicable taxes and the total amount payable are presented by Paddle at checkout before the purchase is completed; in case of discrepancy, the amount shown at checkout prevails.

Paddle takes the payment and issues the receipt or applicable commercial document. The Academy does not receive full payment-card details and does not issue the buyer a second invoice or receipt for the transaction.

5. Delivery and refunds

The product is made available by the Academy after Paddle confirms the transaction, by email and/or a download link.

You can request a refund within 14 days of purchase. Cancellations and refunds relating to the transaction are processed by Paddle in accordance with the Paddle Buyer Terms and Paddle Refund Policy, without prejudice to applicable mandatory rights.

Where the product is the annual pass, access is made available for the duration of the subscription. Cancellation of the subscription is made through Paddle and takes effect at the end of the period already paid for; access continues until then and is not refunded pro rata. Content already made available to the buyer remains available after the pass ends, on the terms set out in 3.1. The refund arrangements set out above are unaffected, as are any mandatory statutory rights available to you.

The Academy provides support for delivery, access and conformity of the product. Refunds are processed by Paddle.

6. Product conformity

The Academy is liable for the non-supply of the product and for lack of conformity of the content within the periods and conditions imposed by applicable law. Where Decree-Law No. 84/2021 applies, the Academy is responsible for non-supply and for lack of conformity for the periods applicable under that legislation, taking account of whether the product is supplied by a single act (the occupation document) or continuously for a contractual period (the annual pass).

The buyer should contact academy@josecovas.com, quoting the transaction reference and describing the problem. The Academy will seek to restore conformity, restore access or, in accordance with applicable law, ask Paddle to process a price reduction or refund.

7. Support

The Academy provides support relating to the product itself — delivery, the private page, the download link, access and content. Questions about payment, tax, the receipt, cancellation of the transaction or refund processing are handled by Paddle buyer support, via the links on the Paddle receipt or Paddle's support platform.

8. Licence and permitted use

On completion of the transaction, the buyer receives a non-exclusive, non-transferable licence for internal use of the product, including the private page and any PDF. Where the buyer is an individual, the licence is for their personal, professional or educational use. Where the buyer is a legal person, the product may be used internally by that entity and by its employees and collaborators in the exercise of their duties.

Limited quotations are permitted, with clear identification of SHIFT as the source. It is not permitted to resell, publicly redistribute, publish in full, sub-licence, make available to third parties or systematically extract the product, nor to use it to create a competing dataset or service, without prior written permission. All intellectual-property rights remain with the Academy and its licensors.

9. Liability

The products provide general information and are not a substitute for professional advice tailored to the user's specific circumstances. The user is responsible for evaluating the information and for the decisions taken on the basis of it.

To the extent permitted by law, the Academy is not liable for indirect or consequential loss. Nothing in these Terms excludes or limits liabilities or rights that cannot lawfully be excluded or limited, in particular liability for wilful misconduct, gross negligence, death or personal injury caused by negligence, non-supply or lack of conformity, or consumers' mandatory rights.

10. Data protection

Personal data are processed as described in the Privacy Policy. Paddle processes buyer and payment data as an independent controller for the transaction; the Academy processes, as an independent controller, the data it receives or collects to deliver the product, manage the licence and provide support.

11. Complaints and dispute resolution

Complaints about the content, delivery, licence or support of the product may be addressed to the Academy and, where applicable, referred to our ADR entity, as set out on the Complaints & dispute resolution page. Matters concerning payment, tax, the receipt, cancellation of the transaction or refund processing should be addressed to Paddle buyer support.

12. Governing law and jurisdiction

The purchase, payment, taxes, transaction receipt and the processing of cancellations and refunds are governed by the Paddle Buyer Terms, including their governing-law and jurisdiction provisions.

The relationship between the buyer and the Academy concerning the delivery, licence, use, support and conformity of the product is governed by Portuguese law. This choice does not deprive a consumer of any mandatory protection or jurisdiction rights granted by applicable law. Where the buyer acts in the course of a trade, business, craft or profession, the courts of Lisbon, Portugal, have exclusive jurisdiction over disputes relating to these Terms, except where mandatory law provides otherwise.

13. Legal identity and contact

14. Changes

We may update these Terms. The version applicable to a purchase is the one in force when the transaction is completed, and the applicable version is recorded for each transaction. Effective date: 1 August 2026. Last updated: 20 August 2026.
